Thousands of Britons transferred to the US by their employers face the threat of losing their work visas under changes imposed by the Trump administration.
A rule which treated the renewal of L-1B visas as routine has been scrapped by the Department of Homeland Security, meaning that UK nationals who have been in the US for years have to apply from scratch for a fresh visa if they want to stay in the US.
With the Trump administration pursuing a “hire American, buy American” policy, immigration lawyers have warned that renewal is not guaranteed if officials believe that a US national could do the same job. This comes at a time when, lawyers say, the US Consulate in London is turning down L1 visa applications which in the past would have been granted.
The sweeps by Immigration and Civil Enforcement (ICE) largely aimed at Latin Americans in the US, and Donald Trump’s much vaunted wall have caught the headlines. But the crackdown is far more widespread, threatening to hit professionals from across the world who entered the country legally.
The changes are in a policy memorandum issued by the US Citizenship and Immigration Services section of the Department of Homeland Security. It reverses the policy, which has been in place since 2004, which said that immigration adjudicators should “defer” to the decision made by officials at the time of the original application.
